Il sistema dei rimedi e le indennità nel licenziamento illegittimo

The essay analyses the remedial perspective relating to the legal consequences of unlawful dismissals. The severance payments as fixed and standardised legal settlements do not seem to be connected to compensation for damages in specific form or for equivalent as well as to the principle of personalisation, otherwise the hazard is an undue assimilation between different situations with violation of the principle of equality. For this reason, the severance payments are excluded from the remedies system, as they risk not guaranteeing the interests of the workers excluded, even the pecuniary interests sacrificed by the unlawful exercise of the employer’s power.

Il saggio analizza la prospettiva rimediale in relazione alle conseguenze giuridiche dei licenziamenti illegittimi. Le misure indennitarie, intese come liquidazioni legali forfettizzate e standardizzate, non sembrano connesse al risarcimento del danno in forma specifica e per equivalente e al principio della personalizzazione anzi si traducono in una indebita assimilazione di situazioni diverse con violazione del principio di eguaglianza. Per tale ragione, le indennità sono escluse dal sistema dei rimedi, in quanto rischiano di non garantire gli interessi dei lavoratori estromessi, anche quelli patrimoniali sacrificati dall’esercizio illegittimo del potere datoriale.
