Aspetti legislativi e legali delle Nuove Sostanze Psicoattive (NPS) e applicazioni analitiche a contrasto di un fenomeno globale

This work has been developed in 6 chapters plus conclusions, in which the legislative and legal aspects concerning the New Psychoactive Substances (NPS) are discussed, and the current problems to contrasting the phenomenon. The first 2 chapters were dedicated to Presidential Decree 309/90 and the Tables contained therein, in which the narcotic and psychotropic substances under consideration at various legal levels are reported. In these first 2 chapters the role played by the European Observatory on Drugs and Drug Addiction (EMCDDA) is also highlighted, but above all the role of the Early Warning System (SNAP) in the inclusion of NPS in the Tables attached to Presidential Decree 309. / 90. In chapter 3 described the biological and non-biological matrices suitable for the research of NPS, and the scientific limits that often prevent their revelation. Furthermore a part has been dedicated to informed consent for the collection of the biological matrix. Chapter 4 focuses on Forensic Toxicology and Legal Medicine aspects that may be the consequence of a determination of the NPS in biological matrix. Chapter 5 discusses the most important aspects deriving from the use of the keratin matrix in the toxicological tests of NPS. Chapter 6 also introduces an experimental work related to a screening analysis method on keratin matrix with the LC-HRMS technique, as a proposal for a valid means in the research of NPS. The method was applied to real samples whose results are presented. Finally, a separate chapter was dedicated to the Conclusions.

Il presente lavoro di tesi è stato sviluppato in 6 capitoli più le conclusioni, in cui vengono discussi gli aspetti legislativi e legali riguardanti le Nuove Sostanze Psicoattive (NPS), e quelle che sono le problematiche attuali a contrasto del fenomeno. I primi 2 capitoli sono stati dedicati al DPR 309/90 e alle Tabelle in esso contenute, in cui vengono segnalate le sostanze stupefacenti e psicotrope attenzionate a vari livelli sul piano legale. In questi primi 2 capitoli viene posto in evidenza anche il ruolo che svolge l’Osservatorio Europeo sulle Droghe e delle Tossicodipendenze (EMCDDA), ma soprattutto il ruolo del Sistema di Allerta Precoce (SNAP) nell’inserimento delle NPS nelle Tabelle allegate al DPR 309/90. Nel capitolo 3 vengono descritte quali sono le matrici biologiche e non biologiche idonee alla ricerca delle NPS, e i limiti tecnico scientifici che spesso ne impediscono la rivelazione, inoltre è stata dedicata una parte al consenso informato per il prelievo della matrice biologica. Il capitolo 4 si sofferma sugli aspetti Tossicologico Forensi e Medico Legali che possono essere la diretta conseguenza di una mancata determinazione delle NPS in matrice biologica. Nel capitolo 6 vengono discussi gli aspetti più importanti che derivano dall’utilizzo della matrice cheratinica negli accertamenti tossicologici delle NPS. Nel capitolo 5 viene introdotto anche un lavoro sperimentale relativo ad un metodo di analisi di screening su matrice cheratinica con tecnica LC-HRMS, come proposta di un valido mezzo nella ricerca delle NPS. Il metodo è stato applicato a campioni reali di cui vengono presentati i risultati. Un capitolo a parte è stato infine dedicato alle Conclusioni.
