Recenti modifiche legislative in tema di aiuti di Stato tra centralizzazione dei controlli sulle notifiche e decentralizzazione delle procedure di recupero

This article examines the amendments recently introduced to Law No 234/2012 regard- ing State aid in order to improve the Italian institutional and legislative framework, pursuant to the Common Understanding on Strengthening the Institutional Setup for State Aid Control in Italy concluded between the Italian government and the Commission. The article analyses in detail such amendments and draws some reflexions. In particular, it highlights the lack of coherence in the choice of centralising control over State aid notifications and, at the same time, decentralising recovery procedures.
