The Israeli military intervention in Gaza after 7 October 2023, of uncertain legitimacy according to the right of self-defense, has systematically violated the norms of international humanitarian law and the 1948 Convention on Genocide itself, it is argued by many. War crimes and crimes against humanity are frequent in contemporary military conflicts and on the other hand international law is marked by intrinsic weaknesses that jeopardize the possibility of averting or limiting war. However, international law is a necessary resource and in the recent decisions of supranational institutions and courts one can glimpse the signs of a virtuous dialectic between the legal «forming» and the recognition of the plurality of identities, interests, cultures, political experiences, even of the legal systems.
