The essay analyses consequences of the digitization process of the energy market, illustrating how it promotes the use of smart bidirectional contracts in a balancing function of contract content. The personalization of benefits in energy communities presents profiles of merit when the automated decision is in accordance with article 22 of the GDPR and the Artificial Intelligence Regulation. The attention is placed on the fact that digitalization is a possible amplifier of imbalances and contractual abuses, a phenomenon found in some important decisions made by the Data Protection Authority against economic operators in the energy market. In this context, new challenges for the protection of individuals are posed by the management of liability for technological development and cyber risk.
