Riforma Cartabia: il nuovo regime di perseguibilità delle lesioni personali e il suo impatto sull’obbligo del referto

The Authors analyze, in this short essay, that part of the reform ofthe trial and the penal sanction system (‘Cartabia’ law) which has changed the system of prosecutions of certain off ences. And they do so in a practical perspective with the aim of verifying whether and how the legislative novella has changed the perimeter of the information obligations placed on the doctorand other professionals of health. The Authors focus on in particular, on situations of impaired protection of the person caused or by the existence of an illness orby his age; especially of the older ones seen and considered that the protection of old age is a frontier of justice little frequented despite the particularity of the requests and needs expressed by the multitude of people who are part of it. And that appeal our askingthose responsible for care not to lower the level of guard imposed by the rules of solidarity and the right of citizenship.
