La distribuzione delle competenze tra i diversi livelli di governo al tempo del covid-19 e i riflessi sugli atti

This paper fits within the contest of the current debate about corona virus spread and discusses the effects of imposed emergency rules. Even when the emergency measures are temporary and provisional they potentially show definitive consequences impacting relationships among sources of law. This essay, therefore, focuses on analysing whether and how these measures affect the powers of the State entities and local authorities during the health emergency in order to understand if the system for allocating powers is capable to resist emergencies.

Il contributo intende partecipare al dibattito sorto intorno alla diffusione mondiale del virus Covid-19 riflettendo sulla normazione emergenziale prodotta in Italia e sui suoi effetti. I provvedimenti emanati durante questa emergenza sanitaria, seppure per natura temporanei e provvisori, producono conseguenze potenzialmente definitive e incidono sui rapporti tra le fonti normative. L’intento è analizzare se e come detta normativa muta i poteri e le competenze degli organi dello Stato e degli enti locali in occasione dell’emergenza sanitaria, per comprendere fino a che punto il sistema di attribuzione dei poteri è capace di “reggere” alle sollecitazioni imposte dalle emergenze.
