On July 6 the United States formally began its withdrawal from the World Health Organization, accused of having been too accommodating, not to say supine, towards China with regard to the management of CoViD-19. This work essentially describes a brief legal reconstruction of the origins, structure and resources of the WHO, in order to note how the empowerment deficiencies of the Organization are due ab initio to the will of the States that gave it birth. Secondly, through a sort of chronicle of the current health emergency, from the first cases of “pneumonia of unknown cause” in Wuhan to the declaration of a pandemic, an attempt will be made to highlight the role assumed by the WHO to face CoViD-19 through the worldwide coordination of the multilateral response versus the (improvised) action of governments, with which many of them, in defiance of the principle of solidarity enshrined in art. 44 International Health Regulations of 2005, are facing this health challenge, of unprecedented complexity.
Il 6 luglio gli Stati Uniti hanno dato inizio al processo formale di recesso dall'Organizzazione mondiale della sanità, accusata di essere stati troppo accomodante, per non dire supina, nei confronti della Cina nella gestione del CoViD-19. Questo lavoro prende le mosse, in prima battuta, da una breve ricostruzione giuridica delle origini, struttura e risorse dell'OMS, al fine di evidenziare come le carenze di empowerment dell'Organizzazione siano dovute ab initio alla volontà degli Stati che le hanno dato vita. In secondo luogo, attraverso una sorta di cronaca dell’attuale emergenza sanitaria, nell’arco temporale che va dai primi casi di “polmonite di causa sconosciuta” manifestatisi a Wuhan alla dichiarazione di una pandemia, si cerca di evidenziare il ruolo assunto dall'OMS per affrontare il CoViD-19 attraverso il coordinamento mondiale della risposta multilaterale versus l'(improvvis)azione degli Stati, con cui molti di questi, in spregio al principio di solidarietà sancito dall'art. 44 del Regolamento sanitario internazionale del 2005, hanno affrontato questa sfida sanitaria, dalla complessità senza precedenti.
