This paper collects some initial considerations on the possible legal framework of sharing economy as a social phenomenon recently emerging, observed from an enterprise law perspective and ordered around ownership issues. On line platforms impose to redefine the classic features of the enterprise, in order to ascertain if it changes as it involves suppliers of goods and services provided by the platform, as well as users themselves, into the management of a collaborative enterprise. In the first part of the work the relevant themes are organized around the notion, that is more problematic than dogmatic, of the collaborative enterprise as a terminal, someway irreversible phase of the evolution of the capitalist enterprise. In the second part, the work focuses on the different meanings of «ownership» in the collaborative enterprise, ordered according to the threefold perspective of the ownership of the company, the productive means and the results of the activity, highlighting a series of problems requiring harmonious solutions with enterprise law. The third part of the work contains some food for thought about new goods in collaborative enterprises which, thanks to technological and digital innovation, are now a forge of new goods previously out of the market or having markets strongly delimited by structure and area; these new markets have peculiar characteristics compared to traditional markets, with evident effects on contract law, producer-consumers dynamics and competition rules. L’articolo raccoglie alcune prime considerazioni sul possibile inquadramento giuridico del fenomeno economico e sociale, di recente emersione, della sharing economy, osservato da una prospettiva di diritto dell’impresa ed ordinato attorno alle tematiche lato sensu proprietarie. La configurazione delle piattaforme collaborative impone una ridefinizione dei connotati classici della fattispecie impresa, al fine di accertare se essi si modificano in ragione del coinvolgimento a vario titolo dei prestatori di beni e servizi erogati dalla piattaforma (quando non, addirittura, degli stessi fruitori degli stessi) nella gestione dell’impresa. Nella prima parte del lavoro i temi di rilievo sono ordinati intorno alla nozione, più problematica che dogmatica, dell’impresa collaborativa come fase terminale e per certi versi irreversibile dell’evoluzione dell’impresa capitalistica. Nella seconda parte il lavoro si sofferma sulle diverse accezioni della «proprietà» nell’impresa collaborativa, ordinate secondo la triplice prospettiva della proprietà dell’impresa, dei mezzi produttivi e dei risultati dell’attività, evidenziando una serie di problemi bisognosi di soluzioni armoniche con il diritto dell’impresa. La terza parte del lavoro contiene alcuni spunti di riflessione sui «nuovi beni» che caratterizzano le imprese collaborative le quali, grazie all’innovazione tecnologica e digitale, sono ormai una fucina di nuovi beni in precedenza fuori mercato o aventi mercati fortemente delimitati per struttura e ambito territoriale; questi nuovi mercati presentano connotati peculiari rispetto ai mercati tradizionali, con evidenti ricadute sul piano del diritto dei contratti, dei rapporti con i produttori-consumatori, delle regole di concorrenza.
