In September 1993, the World Bank established an independent panel (Res. Nos. 93-10 and IDA 93-6) in response to outside criticism that Bank-financed projects often cause more environmental and social harm than good. The Inspection Panel acts as a “forum” to receive and investigate complaints against the Bank from local groups in developing countries who believe they have been or could be adversely affected by bank-financed projects. The reference to “forum” disguises the potential of the Panel to function as a quasi-judicial body and to arrive at a determination, after an enquiry conducted in a fair and equitable manner and in accordance with the rules of law derived from the legal framework, however complex, to which all parties concerned, including the Bank, its managers and staff and executive Directors, are subject. This contribution will puts particular weight upon the legal perspective of analysing the implementation of effectiveness of no-trade values in World Bank’ activities in order that to see whether countries perceive the Bank as an effective partner in promotion environmental standards and their funding practices.
